Every web browser, apart from Opera Mini and Google’s native browser on Android, offers the option to switch on third-party cookie blocking. Apple’s browser automatically blocks these on all of its devices as standard to prevent advertisers from gathering and selling information about web activity.

Oxygen8 Money, which provides mobile money solutions, has been granted an Authorised e-Money Licence by the Financial Services Authority (FSA). The licence makes Oxygen8 Money an approved issuer of electronic money, placing them amongst a select few businesses on the FSA E-money Register.
In a move that everyone in the mobile marketing industry will surely applaud, the Information Commissioner’s Office (ICO) has slapped a £440,000 fine on the two owners of Tetrus Telecoms (can’t find a website for them, surprisingly – Ed) which has, in the ICO’s words: “plagued the public with millions of unlawful spam texts over the past three years”.

There can be few people in the mobile marketing community whose heart doesn’t sink every time they receive another spam text message on their mobile. The increase in this type of activity only serves to reinforce the misconception prevalent among some consumers that mobile marketing in invasive and does not respect their privacy – something that could not be further from the truth.
Velti has closed a $27m (£17m), 2-year deal to provide its mobile marketing technology to “a major US brand”. The program is expected to break in the next few weeks, and is designed to drive increased engagement with the brand’s existing customers, with the aim of increasing loyalty.

The Apple vs Samsung trial in California is raging on unabated, as both companies try to prove that they didn’t rip off the others’ designs. And, as well as all the expected wrangling – Apple demanding a record $2.5bn in damages, Samsung accusing the iPhone of not being particularly original in the first place – it’s providing a lot of fascinating insights into what’s been going on behind the scenes at two of the world’s biggest smartphone manufacturers.
The legal battle between Samsung and Apple – which has seen the two firms accuse each other of patent infringement – has reached trial. Taking place later today in a Californian federal court, the trial could see the companies force pay billions in damages, or even lead to a sales ban.
card.io employees will join the PayPal product team to develop technology and apps around digital wallets. Existing card.io technology remain available to developers using it in their own apps.
Facebook has acquired the talent behind internet startup Spool for an undisclosed sum. Spool is an app-based service allowing users to share content via mobile. In an unusual deal, the employees and IP of Spool will transfer to Facebook, and its apps will close, but Facebook will not acquire the company.
It’s been a rough few months for RIM, announcing losses of $518m and cutting 5,000 jobs – but at least, you might think, it can’t get any worse for the BlackBerry manufacturer. It has, though, with the company being ordered on Friday to pay $147.2m (£94.7m) in damages to device management company Mformation Technologies.
Following a two-year legal battle, Google has come out victorious in a patent infringement case brought on by Oracle. The chief executives of both companies testified during the trial in the U.S. District Court of Northern California, where a jury unanimously declared that Android did not infringe on Oracle’s six patents in question.

The United States Patent and Trademark Office (USPTO) has awarded NeoMedia a patent pertaining to the resolution of mobile barcodes.
Patent No. 8,131,597, entitled, System And Method For Using An Ordinary Article Of Commerce To Access A Remote Computer, generally covers systems and methods for providing users of mobile barcodes automatic access to remote computers.

Apple has responded to Nokias legal action against the company by filing a countersuit claiming that Nokia is infringing 13 of Apple's own patents.
Other companies must compete with us by inventing their own technologies, not just by stealing ours, says Bruce Sewell, Apples General Counsel and Senior Vice President.
Nokias lawsuit against Apple, alleging that the iPhone infringes 10 of Nokias patents, could result in settlement even higher than the $612 million (375 million involved in the Blackberry case in 2006. But in contrast with that earlier case, this one is unlikely to lead to threats to cut-off the iPhones 30 million users.
Thats the view of Nicholas Fox, a Chartered Patent Attorney at London-based Ipulse, who says:
Red Bend Software has been issued with two new patents by the United States Patent and Trade Mark Office. The patents cover revertible and failsafe features of Red Bends already patented in-place update methods used for managing software on mobile devices. Both features improve the user experience and enable Red Bends customers to reduce support costs and increase service revenues.
In response to the Federal Communications Commission Notices of Inquiry into the United States Wireless Communications Market (FCC 09-157 and 09-51, and FCC 09-66) , the Mobile Marketing Association (MMA) has submitted two responses to the FCC. The first response is to the Notice of Inquiry into the Competitive Market Conditions. The second response is to the Notice of Inquiry into Innovation and Investment.
The Mobile Entertainment Forum (MEF) is to stage a tour of four key Southeast Asian countries to foster collaboration between regulators and members, and create an environment conducive to the mobile media industrys continual growth and vibrancy. Mobile transaction network mBlox has issued a statement concerning investigations in to UK breaches of PhonepayPlus Code of Practice. mBlox has been the subject of an increasing number of PhonepayPlus adjudications, and says it has released the statement in order to put these in context and make it clear that these are historical problems which have been addressed by mBlox in conjunction with PhonepayPlus. The statement reads:
AdaptiveMobile, which provides mobile subscriber protection for enterprises and individuals, has urged mobile operators worldwide to follow the example led by the United States, where this week three of the largest Internet Services Providers (ISPs) – Verizon, Sprint and Time Warner Cable – committed $1 million (500,000) to help block access to explicit child sites and bulletin boards, marking a first move of ISPs giving into government pressures of ‘policing’ the Internet.
Starhome, which provides roaming services and converged solutions, has announced that it has been granted a US patent (US patent No: 7,356,337) for an innovative solution for home shortcode resolution. The new technology, for use by mobile subscribers while roaming, enables shortcode numbers to be translated on the handset in order to drive a higher call completion rate and to increase user satisfaction.
Telecoms regulator Ofcom has confirmed that mobile operator O2 has now met its obligation to roll out its 3G services to at least 80% of the UK population. This follows Ofcom’s notice to O2 in February that it would shorten its licence by four months if it did not comply with its rollout obligation by 30 June 2008. O2 acquired its 3G licence in 2000 for 4,030 million.
Communications regulator Ofcom has proposed new rules to tighten the regulation of television and radio programmes that rely heavily on premium rate telephone services (PRS). The proposed new Broadcasting Code rules will ensure that programmes that invite viewers and listeners to interact or participate are not vehicles for promoting commercial, revenue-generating services.
Mobile operators serving 550 million customers in the
European Union are putting in place safeguards to ensure that children can
safely access content on mobile phones, as part of a programme coordinated by GSM Europe, the European arm of the GSM Association.
The Mobile Marketing Association (MMA), which represents more than 500 member companies worldwide, has released the latest edition of its Consumer Best Practices (CBP) Guidelines for cross-carrier mobile content services in the United States. The MMA says the Guidelines, updated twice annually, have become the baseline set of rules for cross-carrier mobile content services in the United States. The Guidelines can be downloaded here.
The Mobile Entertainment Forum (MEF) Europe has launched its guide to the AMS (Audiovisual Media Services) Directive at a members’ workshop with the Department for Culture, Media and Sport (DCMS) and Ofcom. The MEFs Practical Guide’ aims to help the many mobile entertainment companies affected by the Directive understand both its impact, and the potential opportunities it will create across the single market.
The Direct Marketing Association (DMA) is urging marketers to exercise caution when considering the permission implications of Bluetooth following the Information Commissioners Offices (ICOs) recent decision to exclude Bluetooth from its guidance on compliance with the Privacy and Electronic Communications Regulations (PECR).
Bluetooth marketing is in the news again, following the Information Commissioners Offices decision to update its guidance for marketers on the Privacy and Electronic Communications Regulations 2003. The updated guidance removes Bluetooth from the list of communication methods that require the users opt-in permission.
Crazy Frog service provider mBlox has been hit with an unwanted Christmas present in the shape of a 40,000 fine and formal reprimand by telecoms regulator ICSTIS. mBlox has also been ordered to pay refunds to all those who complained to the regulator. The adjudication follows a lengthy investigation and subsequent Oral hearing with mBlox, Jamba, and their legal representatives.
Although Jamba itself was not fined, the fine will be passed on to Jamba by mBlox.
Jonathan Bass, managing director of mobile marketing agency Incentivated, has warned mobile marketers to ensure they stay on the right side of the law when outsourcing the broadcasting of SMS campaigns. According to Bass, many companies are inadvertently breaking the law by transferring customer data outside the EU, in order to execute campaigns, something that breaches the 8th principle of the Data Protection Act.
