Blackberry has filed a lawsuit against Facebook, and its WhatsApp and Instagram apps, for patent infringement regarding technology and features allegedly copied from Blackberry Messenger.

The filing with a Los Angeles federal court states that the “defendants created mobile messaging applications that co-opt Blackberry’s innovations, using a number of innovative security, user interface, and functionality enhancing features.”

The lawsuit is all part of the Canadian-based company’s plans to make money via legal avenues. It follows a suit filed against Nokia last year alleging that the Finnish company uses transmitter and software that infringe on Blackberry’s intellectual property.

“Protecting shareholder assets and intellectual property is the job of every CEO,” a Blackberry spokeswoman told Reuters while noting that patent infringement lawsuits were “not central to BlackBerry’s strategy.”

Facebook, as expected, has come out with intent to fight the lawsuit – while somewhat accusing the company of giving up on trying to stay relevant.

“Blackberry’s suit sadly reflects the current state of its messaging business,” said Paul Grewal, Facebook’s deputy general counsel. “Having abandoned its efforts to innovate, Blackberry is now looking to tax the innovation of others.”
