Judge Orders Another Trial in Samsung and Apple Patent Case

The damages awarded to Apple from Samsung after their patent infringement trial last year have been slashed by the judge who oversaw the case.
The $1.05bn has been reduced by 40 per cent to $630m after Judge Lucy Koh said that incorrect calculations were made by the jury in relation to a number of the 14 devices. A new trial has been ordered to decide the total damages for the smartphone and tablet designs still in dispute. Apple had filed a motion for an increase in the award but this was rejected.
Samsung was accused of copying patents for the iPhone and iPad, including the screen bounce and zoom features. The jury rejected its claim that Apple had breached some of its patents but the damages awarded were significantly lower than the $2.5bn originally requested by Apple.
In a statement, the Korean company said: “We are pleased that the court decided to strike $450,514,650 from the jurys award. Samsung intends to seek further review as to the remaining award.”
