German appeals court rules in favour of AdBlock Plus in publisher battle

AdBlock PlusThe German appellate court in Munich has ruled in favour of AdBlock (ABP) in all of its three separate cases against German publishers.

The appeals lodged by RTL Interactive, ProSiebenSat.1 and Süddeutsche Zeitung relate to cases that were originally brought forward against ABP regarding their whitelisting practices. All three publishers lost the first time around, and the appeals court has decided this initial decision was the right one.

The new ruling does, however, make one change. It contradicts an earlier finding in the case of Axel Springer – another German publisher that has taken ABP to court in the past – which took issue with certain aspects of the whitelisting program. Under this updated ruling, it is no longer considered a breach of competition law for a company to maintain a whitelist and offer related services to other companies.

The Munich court, allegedly, told the plaintiffs to focus their energies on finding alternative business models.
